Before accepting the keys to a new Spanish home, identify the occupation procedure that applies to that property and obtain evidence that its requirements have been met. The document may be called a first occupation licence, but some locations use a responsible declaration or prior communication. Asking for the correct evidence is more useful than insisting on one English label.

Three milestones that should not be merged

Construction can be physically finished, technically certified and ready for lawful occupation at different points. The builder finishing the kitchen does not itself complete the administrative process. Nor does a final works certificate automatically explain the status of every occupation requirement or utility connection.

Spain’s Building Regulation Act distinguishes building reception and documentation, and refers to documents enabling occupation in its advance-payment framework. For a buyer, the practical task is to map each milestone to evidence, rather than treating “finished” as a complete answer.

If you are still choosing a development, start with the broader off-plan purchase checks. Near handover, ask for the actual completion and occupation pack for your unit. A generic sales brochure is no longer enough to organise final payments and a move.

Why a developer may supply a declaration instead of a licence

Regional rules determine the procedure, with municipal implementation. Andalucía’s Law 7/2021, article 138, provides for a responsible declaration in specified occupation cases involving completed works that meet the relevant authorisation and applicable rules. The declaration is not a way to make non-compliant construction acceptable.

In Catalonia, the Generalitat’s habitation-certificate guidance identifies first-occupation documentation and the municipal communication where required. This illustrates another important distinction: an administrative habitation certificate and the local planning-related occupation step may both need attention.

Ask the adviser dealing with your purchase to name the correct local procedure, explain its effect and identify the relevant file. If the response is “licences are no longer issued here”, the follow-up is “what evidence replaces it for this property?” It is not a reason to stop checking.

Match every document to the unit being handed over

Read the address, building, phase and dwelling identifier on the paperwork. Developments may be delivered in stages, and a document covering one block may not answer questions about another. Establish how parking, storage and essential shared facilities appear in the handover arrangements.

Understand the evidence under a declaration procedure

A declaration-based system may not produce the same affirmative decision that buyers expect from a traditional licence. That does not make it inherently defective. Equally, a stamped cover sheet is not enough to establish that every necessary condition and attachment has been satisfied.

Under the Andalusian framework cited above, the required documentation and subsequent public checking powers remain significant. Your review should therefore address the content, filing and conditions of the declaration, plus any known administrative issue. Do not infer approval merely because nobody has objected in a casual conversation.

Imagine a fictional phased development. Your apartment is in the second phase, but the developer emails an occupation document bearing the first phase’s reference. The sensible response is to request the matching file and understand any shared-facility dependency. It is not to assume the whole development is either fully authorised or unlawful from that mismatch alone.

Ask what happens to electricity and water after handover

Lighting at a viewing can be supplied through arrangements that tell you little about an individual permanent contract. Ask for the relevant installation documentation and supply identifiers, and find out which occupation evidence each provider requires. Separate the connection being physically present from your ability to contract and use the service.

Article 142 of the Andalusian law connects definitive utility contracting with the applicable occupation or use documentation. Other locations need their own checks. Obtain a practical status report for the actual dwelling, including missing steps and who is responsible for them.

If you are told that the home has no habitation certificate, identify whether that document is required locally and why it is missing. Put the paperwork into the completion decision

Give the occupation pack to the person advising on the purchase contract before confirming the completion arrangements. Ask how the available evidence meets the agreed delivery terms. If something essential is missing, obtain advice on the options; do not improvise a waiver or assume you can cancel without considering the contract and applicable law.

Where you are still negotiating, reflect important dependencies in the reviewed reservation or arras agreement. Then coordinate the documents, final inspection, payment and keys through the wider purchase process. Keep copies accessible after you move, because future utility, sale or alteration enquiries may require them.

The next useful request is simple: ask for an indexed handover pack for your exact property, with outstanding items marked. Share the municipality, type of home and intended handover date if you want to describe the checks you need before arranging the move.
