Spain has recreated the TU CASA financing line in Royal Decree-law 29/2026, published on 7 October and generally due to take effect on 8 October. This is a new measure following the congressional repeal of the previous decree on 2 October. The programme has a legal basis again, but there is still no live route for a buyer to apply.
What the new decree actually provides
TU CASA is intended for people buying their first mortgaged habitual home, regardless of age. It would sit alongside private mortgage finance and cover the lower of 20% of the property value or €50,000. The public loan carries 0% interest and no commissions.
Those headline terms do not guarantee approval and do not require a bank to fund the balance. The Instituto de Crédito Oficial will assess each operation under its risk policies and conditions that have yet to be adopted. A Council of Ministers agreement must still define eligibility, further limits, the opening allocation and the application procedure.
Why it should not appear as confirmed cash yet
No application form, opening date or final eligibility test has been published. Until that changes, build the purchase around savings and documented finance only. The purchase-cost calculator separates the property price from taxes and completion costs, while the total-cost guide helps protect the cash reserve needed after completion.
Illustrative example: 20% of a €240,000 home is €48,000, below the €50,000 ceiling. That is a theoretical maximum under the decree, not an awarded loan. A prudent funding plan should continue to label the €48,000 as unconfirmed until the buyer meets the final rules and passes the ICO assessment.
The property carries lasting restrictions
The home must remain the buyer’s habitual residence and a resale-price limit will be recorded in the deed and Land Registry. A later sale generally cannot exceed the original purchase price adjusted with inflation, subject to future rules for specified improvements. If the property is rented, its rent must remain below the applicable state reference ceiling.
A mortgage valuation will still matter when testing the gap between price and available lending. Use the finance calculator to compare plans with and without TU CASA. As a decree-law, the measure must also go through Congress’s constitutional validation process. Buyers should therefore treat it as a developing financing option until the parliamentary outcome and operating rules are officially published.
