Update on 7 October: Congress did repeal Royal Decree-law 26/2026 on 2 October, but the government has now published Royal Decree-law 29/2026, recreating TU CASA with general commencement on the 8th. This page preserves the history of the first decree; the conclusion that the programme had disappeared was accurate only during the gap between the two measures.
What happened to the original decree
Royal Decree-law 26/2026 was published on 30 September, took effect on 1 October and was repealed by Congress the following day. The official resolution removed that version of the mechanism, leaving no live legal basis for an application process for several days.
The repeal has not been reversed retrospectively. TU CASA returns because later legislation establishes it again. Keeping the two decrees separate matters when checking their validity, dates and parliamentary validation.
What the later decree changes
Royal Decree-law 29/2026 restores the core outline: a first mortgaged habitual home, complementary public finance equal to the lower of 20% of the property value or €50,000, 0% interest and no commissions. However, the Council of Ministers must still set eligibility, further limits, the initial allocation and the procedure, while the ICO will assess individual operations.
TU CASA therefore exists in legislation again but is not confirmed cash for a transaction. Use the purchase-cost calculator with savings and approved borrowing only. The total-cost guide separates the price, buyer taxes and the post-completion reserve.
How to handle it in a purchase plan
Illustrative example: 20% of a €220,000 home is €44,000, again below the statutory ceiling. That does not amount to an ICO approval. Keep a scenario without TU CASA in the project-budget calculator until the rules are published and an application succeeds.
The later decree also restores financing measures for industrialised construction, subject to their own conditions. Project owners can compare systems in the modular and traditional construction guide, without treating a public guarantee as secured before the project is confirmed as eligible.
