Spain has clarified a small but potentially disruptive step in registering a completed new building. A decennial-insurance certificate or the endorsement bringing the policy into force may carry qualified electronic signatures. A notary or Land Registrar should not reject it merely because there is no handwritten signature, provided the digital evidence can be checked in the prescribed way.
This is relevant to developers and self-builders whose project must prove the ten-year structural guarantee. It does not impose new cover or rewrite the statutory self-builder exception. Start with the project-specific test in our decennial-insurance guide before treating the document format as the main issue.
What the digital file needs
The insurer’s document should show a secure verification code, known in Spain as a CSV, or a QR code. This gives the notary or registrar a route to compare a printout with the insurer’s authentic online document. The electronic file must also preserve the signatures’ integrity, commonly through a PAdES-signed PDF.
Where a qualified electronic signature is used, the certificates for the insurer’s representative and policyholder or developer must come from a qualified trust-service provider. The instruction mentions the FNMT as one example, not as the only provider.
A pasted picture of a signature is not the same thing. The practical question is whether the receiving professional can establish who signed, validate the certificate and detect a later alteration to the PDF.
A cleaner route from insurer to deed
When the insurer supplies the final certificate or commencement endorsement electronically, the original signed PDF should go directly to the notary. Once incorporated into the notarial deed, it can support registration at the Land Registry. The instruction also allows delivery through the Spanish registrars’ application for private documents.
Ask for the native signed file rather than relying on a scan. Test the CSV or QR on a separate device, and confirm that the notary has the same version. The handover should be coordinated with the final works certificate and the new-build declaration, not left until the appointment.
What has not changed
The instruction does not prove that a particular policy is active or that its sum insured and scope fit the completed building. Existing information still matters, including the building’s identity, cover, insured amount, commencement, duration, premium, excess and parties.
Illustrative example: a valid QR may remove the need to obtain a handwritten signature, but it cannot repair an incorrect cadastral reference or an inadequate insured amount. Add the confirmed premium, technical control and reporting costs to the construction-cost calculator, then retain the signed original with the permanent building record.
